Implementing the California privacy pop-up

The California privacy pop-up toggle will be available in your Raptive dashboard on May 7, 2026.

As privacy expectations and regulations continue to evolve, many site owners are looking for ways to make their Terms of Service and Privacy Policy more visible to visitors—especially in regions like California, where privacy awareness is higher.

To support this, we’ve introduced an optional California privacy pop-up. This feature is designed to supplement your existing privacy disclosures by presenting them more prominently to California-based users. 

 

Requirements

To enable this feature, your site must meet the following requirements:

  • Your Privacy Policy must be visible and accessible on every page of your site
  • Your Privacy Policy must include the Raptive Advertising Privacy Statement 
  • You must have a dedicated Terms of Service page that includes provisions such as binding arbitration, consent to data collection, and limitations on liability (view sample clauses)

 

What is the California privacy pop-up?

It’s an optional feature that displays a more prominent Terms and Privacy notice to visitors located in California. When enabled, this supplements the standard opt-out banner that sits in the footer and is designed to increase visibility and awareness of your site’s privacy disclosures. 

 

Is this a requirement?

No, if you use our current setup, it follows regulatory guidelines. This is completely optional and turned off by default. 

 

What is the revenue impact?

In our testing, we’ve seen an average revenue impact of approximately 3–4% on California traffic. This is primarily due to higher bounce rates associated with the pop-up experience. It’s important to note this impact is limited to your California audience—not your total site revenue.

 

What does the pop-up look like?

 

Can I customize the pop-up's appearance?

Not at this time. The experience is standardized to ensure consistency and alignment with legal considerations. We’ll share updates if customization becomes available in the future.

 

Can I turn it off later?

Yes, you can toggle the feature on or off any time in your dashboard. The change should be reflected on the site within a few hours, once caches are updated.

 

How do I enable this?

You can find this setting in your dashboard under Ad Preferences, below the Ad Categories section. 

 

What if I don't have either a Terms of Service and Privacy Policy?

You must have a dedicated Privacy Policy and Terms of Service page to be able to enable this feature.

 

Will ad auctions still occur immediately, or wait until consent is enabled?

Yes. Ad auctions will continue to occur immediately and are not delayed by this feature.

 

Is this the same as a CMP?

No, this is a Terms and Privacy pop-up to increase visibility to readers.

 

Will Raptive verify my Privacy Policy or Terms of Service? 

No. Raptive does not review or validate the contents of your policies. You are responsible for ensuring your Privacy Policy and Terms of Service meet all applicable requirements.
