Implementing the California Disclosure Notice

The California Disclosure Notice is an optional Raptive dashboard setting that displays a more prominent Terms of Service and Privacy Policy notice to visitors located in California.

This notice is designed to supplement your existing privacy disclosures by increasing visibility for California-based visitors. It does not replace the standard footer opt-out banner, and it is not required. The feature is turned off by default.

Before you enable

To enable this feature, your site must meet the following Raptive requirements:

  • Your Privacy Policy must be visible and accessible on every page of your site
  • Your Privacy Policy must include the Raptive Advertising Privacy Statement
  • You must have a dedicated Terms of Service page that includes provisions such as binding arbitration, consent to data collection, and limitations on liability

Raptive provides sample language for these clauses, but your legal team is best positioned to advise on what language is appropriate for your site. Raptive does not review or validate the contents of your Privacy Policy or Terms of Service. You are responsible for ensuring your policies meet all applicable requirements.

How this disclosure works

When enabled, the California Disclosure Notice displays a pop-up-style Terms and Privacy notice to visitors located in California. The notice makes your site’s Terms of Service and Privacy Policy more visible and includes links to those pages.

This notice supplements the standard CCPA/CPRA opt-out banner that appears in the footer. It is intended to provide a more prominent disclosure experience for California visitors.

Using the notice with Google Tag Manager consent controls

For non-Raptive tools that need to listen for consent from Raptive’s CMP, such as analytics tools, pixels, plugins, or other tags you manage, you can configure them to listen for consent from the California Disclosure Notice through Google Tag Manager.

GTM consent controls apply only to tags deployed through Google Tag Manager and configured with the appropriate consent checks. They will not automatically control scripts that are hardcoded outside GTM, embedded by third parties, or loaded independently.

How to enable the California Disclosure Notice

You can enable the California Disclosure Notice from your Raptive dashboard:

  1. Go to your Raptive dashboard.
  2. Open Ad Preferences.
  3. Find the California Disclosure Notice setting below the Ad Categories section.
  4. Confirm that your site meets the requirements.
  5. Enable the setting.

Changes may take a few hours to appear on your site once the caches update.

Revenue impact

In testing, we observed an average revenue impact of approximately 3–4% on California traffic. This appears to be primarily related to higher bounce rates associated with the pop-up experience.

This impact applies only to your California audience, not your total site revenue. Actual impact may vary by site.

Frequently asked questions

Is this required?

No. This feature is optional and turned off by default.

Can I customize the notice’s appearance?

Not at this time. The experience is standardized to ensure consistency and alignment with legal considerations. We’ll share updates if customization becomes available in the future.

What if I don’t have a Terms of Service or Privacy Policy?

You must have both a dedicated Privacy Policy and a dedicated Terms of Service page to enable this feature.

Will the notice delay ad auctions?

The feature is not designed to delay Raptive ad auctions. Ad auctions continue loading while the notice appears. 

Can I turn the notice off later?

Yes. You can turn the feature on or off in your dashboard. Changes may take a few hours to appear on your site once the caches update.

Will Raptive verify my Privacy Policy or Terms of Service?

No. Raptive does not review or validate the contents of your policies. You are responsible for ensuring your Privacy Policy and Terms of Service meet all applicable requirements. To learn what Raptive requires and recommends for Privacy Policy regarding ads, you can read more here.

Can Raptive tell me whether enabling this notice is right for my site?
